Traffic Court

Traffic Court is also referred to as Municipal Court. These courts handle minor criminal cases and all motor vehicle matters. Traffic Court is held in the town in which you received the summons or ticket.

DWI/DUI, Refusal to take the breathalyzer
If you have been charged with operating a motor vehicle while intoxicated or refusal to take a breath test, you face very serious mandatory penalties if convicted. For your first offense (if your reading is a .10 or above) you face the possibility of a jail term not to exceed thirty days, a mandatory license suspension of seven months, mandatory participation in the intoxicated driver's resource center and fines and assessments of up to $750 and an insurance surcharge of $1,000 per year for three years. If you have prior offenses that are less than ten years old, the penalties are more severe. Katherine and Francis Hartman were former municipal court prosecutors who have extensive experience handling these matters.

No Insurance
If you are convicted of driving without insurance you will lose your license for one year, be ordered to perform community service, and receive a substantial fine. You could face the possibility of jail, depending on your driving history. We will try to protect you from the possibility of jail and minimize the consequences of these charges.

Traffic Tickets
In addition to expensive fines, (which are doubled in construction zones and 65 mile per hour zones), and possible license suspension, being convicted of a traffic violation can cause you great expense on your insurance premiums. Many traffic violations carry with them "points" which the insurance companies use to justify surcharges or increased premiums. If is important to retain experienced legal counsel to represent you if you have been charged with motor vehicle violations to minimize the impact these tickets may have upon your future.

Suspended Driver's License
If you are convicted of driving while your license is suspended you face an additional period of suspension, substantial fines and in some circumstances mandatory jail. These serious penalties justify retaining experienced lawyers to fight for your rights.

License Problems
If you have problems with your license because of old traffic violations, unpaid surcharges or other administrative issues we can represent you interests before the Motor Vehicle Commission, (formerly DMV) and help you get your driving privileges restored.
